The day I almost got disbarred for telling the truth in court
3 months ago
My brother, you won't believe what happened to me today. I was in chambers with a young lawyer, just giving him some advice on how to handle a difficult land matter. The man was trying to argue that his client had been in possession for 20 years, so he had acquired title by adverse possession.
I told him, calm calm, that the law on adverse possession is not automatic. You need to show that your possession was exclusive, open, and without the owner's permission for the full statutory period. The young man looked at me and said, "But Chief, the judge in my last case said something different." I asked him which judge. He said Justice Okonkwo. I laughed and told him that Justice Okonkwo was my classmate at UNILAG, and we both know that section 48 of the Limitation Law says something else entirely.
The young man went pale. He had been relying on a misquoted judgment he found online. I told him, see ehn, the internet is not the law. The law is what the judge says after hearing both sides. If you don't know the difference, you will lose cases for your clients. He thanked me and left. But I was thinking, how many lawyers are out there practicing based on Google searches instead of the statute books? Na wa oh.
